Tata Motors files complaint for trademark infringement by unknown persons

Automobile giant, Tata Motors has filed a complaint in a Delhi court alleging infringement of its trademark as well as copyright by unfamiliar persons, who are using the company's name for manufacturing and marketing unauthentic ancillary automobile products.

The complaint has sought direction to DCP (District Investigation Unit) Central District to take in custody any person privy to production, storage or sale of any such objectionable articles.

The company has filed its complaint under Trademarks Act, Copyright Act and also under the Indian Penal Code for cheating, forgery using false property mark, possessing instruments for counterfeiting property mark etc.

"The company stands to suffer serious losses and prejudice if any person illegally violates and misuses the trademark and copyright of the company to market its own counterfeit and spurious products of sub—standard quality," the complaint stated.

The unknown people are said to have making the use of the company's name for their inferior products. They possess dies, blocks, plates, instruments, devices and machinery to falsify Tata Motor's trademark.
