What To Do If The Restaurant Includes Service Charge In Your Bill?

Service charges have been a topic of contention for many customers in restaurants around the world. In some countries, including India, it is common for restaurants to levy service charges on top of the goods and services tax (GST). However, this practice has led to confusion and complaints from customers who question the legitimacy of such charges.

Though many customers are unaware that paying a service charge is only required if they choose to. Consumer rights state that if a restaurant pressures a patron to pay service tax, the patron has a right to complain.

Many restaurants and hotels are deceiving their patrons by suggesting that the order would be in effect starting in 2022. Regarding this, consumer forum recently tweeted that no restaurant can pressure any client to pay service charges based on a 2022's order.

The same thing was said by the Delhi High Court on April 12, 2023. No restaurant may impose pressure on its customers over orders placed in 2022, Justice Pratibha Singh further ruled in her ruling. The consumer forum tweeted about this and made a similar statement.

What is Service Charge?

The cost of the ordered food and drinks, as well as any applicable taxes (GST), make up the majority of a restaurant bill. A service fee of 5-10% would also be added to the bill in addition to these by the eateries. Consumers have started to worry about this, which is why the CCPA has established guidelines against service fees in restaurants.

The Central Consumer Protection Authority (CCPA) then declared that service charges are not imposed by the government and declared that they will be completely banned as of July 4, 2022.
A directive outlining the restaurant's rules was published by the CCPA. No hotel or restaurant may impose an additional fee on its patrons, and only those who are satisfied with the establishment's service are expected to leave a gratuity.

What are The Guidelines for Service Charges?

  • There must be no automatic or default service charge added to the food bill in hotels or restaurants.
  • They can't use any other name to collect the service fee.
  • No customer may be required to pay the service fee by hotels or restaurants.
  • The customer must be made fully aware that paying the service price is optional.
  • Restaurants and motels are not permitted to impose restrictions on access or service delivery depending on the customer's payment of service fees.
  • They are not permitted to charge the consumer a service fee, add it to the food bill, and then add taxes to the final total.

What is the Verdict?

The Delhi High Court lifted the CCPA's ban on service fees, but it also states that no restaurant or hotel may require customers to pay any fees. Without the customers' permission, they cannot charge anything. The government must be open and honest about the fees added to the bill. Additionally, it has been observed that most restaurants do not disclose their pricing clearly, and staff members rarely care to inform patrons of this information prior to charging.
On April 12, 2023, the Delhi High Court made it plain that the eateries could not impose fees based on the 2022 ruling. They asserted that they did not support the eateries' efforts to collect any fees.

What to Do If a Restaurant Forces To Pay Service Charge?

According to the CCPA regulations, you can take the following actions if a hotel or restaurant requires you to pay a service charge while breaking the rules:

  • You can ask for the service fee to be taken off the final bill at the restaurant or hotel.
  • Call 1915 or use the NCH mobile app to lodge a complaint against the restaurant with the National Consumer Helpline (NCH).
