A recent complaint has spotlighted the practices of e-commerce giants Flipkart and BigBasket in Tamil Nadu, accusing them of violating electoral laws by making delivery personnel work on the state's voting day, April 19. The allegation was brought forward by Chennai High Court lawyer K Narasimhan, who filed the complaint with Tamil Nadu state election commissioner B Kothi Nirmalasamy. This incident raises questions about the balance between commercial operations and civic responsibilities in the digital age.

Narasimhan's complaint highlights a clear disregard for the state government's declaration of April 19 as a public holiday under section 25 of the Negotiable Instruments Act 1881, aimed at facilitating voter participation in the electoral process. The Labour Welfare and Skill Development Department of Tamil Nadu further mandated a paid holiday for employees across various sectors to ensure their active participation in democracy. Despite these directives, Flipkart and BigBasket allegedly promised guaranteed delivery on election day, potentially infringing on the democratic rights of their delivery staff.
The complaint calls for an immediate investigation into these claims against the e-commerce platforms and seeks measures to protect the democratic rights of workers, regardless of their origin. In response to these allegations, a spokesperson from Flipkart stated that the company is committed to adhering to all guidelines provided by authorities regarding polling day. "At the Flipkart group, we're following all the directives and guidelines provided by the authorities with regard to polling day, and are giving all eligible employees a paid holiday to exercise their franchise. In addition, we have taken steps to drive awareness and encourage employees to vote," said the Flipkart spokesperson.
This situation underscores a growing concern over how major online platforms balance their operational demands with legal and ethical obligations during significant public events such as elections. The outcome of this complaint may set a precedent for how e-commerce businesses operate on legally mandated holidays in India, emphasizing the importance of upholding democratic processes even in the face of commercial pressures.
