Tech Industry Groups in India Oppose Telecom Companies' Demand for OTT Regulation

ITI, ADIF, IAMAI and BIF have voiced their opposition against telecom companies demanding the regulation of over-the-top (OTT) services. They argue that such regulations violate net neutrality principles and overlook the contribution of these services in data usage growth.

Several industry groups, including the Information Technology Industry Council (ITI), Alliance of Digital India Foundation (ADIF), Internet and Mobile Association of India (IAMAI) and Broadband India Forum (BIF) have voiced their opposition to telecom companies' demand to regulate over-the-top services (OTTs) and impose a usage fee. They argue that such demands violate net neutrality principles, while also highlighting the significant role played by OTT services in driving data usage growth.

Telecom operators have been advocating for compensation from OTT players for using their networks. Simply put, OTTs are applications and services that can be accessed via the internet and operate on a network provided by telecom operators. These include popular streaming platforms like Netflix or Amazon Prime Video as well as communication apps like WhatsApp or Skype.

Industry Groups' Argument Against Regulation

In its counter comments submitted to Telecom Regulatory Authority of India's (TRAI) consultation paper on regulatory framework for OTT communication services, ITI has argued against regulation of these platforms. It stated that OTT Services complement rather than replace traditional telecommunications or broadcasting services. Moreover, it pointed out the difficulty in defining what constitutes an 'OTT service', given they often provide bundled offerings that cannot be neatly categorized into 'communication' or 'broadcasting'.

This argument was backed up by ADIF and IAMAI who emphasized on the importance of maintaining net neutrality principles which ensure equal treatment for all internet traffic without discrimination or preference being given to any particular type of content.

The Role Of Existing Regulations

Furthermore, ITI asserted that existing regulations under The Information Technology Act already cover functions performed by these digital platforms making additional sector-specific controls unnecessary. This sentiment was echoed by BIF who labelled telco’s demands for network usage fees from OTTs as outdated and irrelevant in today's digital age.

The contribution of OTT services to data usage growth is significant. These platforms have revolutionized the way content is consumed, leading to a surge in data traffic. This has benefited telecom operators who have seen an increase in revenue from data services.
