Kerala State Lotteries Results:
Bhagyathara lottery ticket has 9 prizes including a consolation prize. The first prize winner got "1 Crore" rupees and the second and third prizes are 75 lakhs and 1 lakh (1 prize in each series) respectively. A total of 6,54,505 prizes were given to the winners. The 12% of the first to third prizes will be deducted and the amount will be given to the agents (who sell the winning tickets) by the lottery agency. In the case of 5th to 8th and the consolation prizes, 10% of the prize amount (agent's commission) will be given from the fund allotted by the government, as per Kerala Lotteries Net.
Kerala Lotteries Taxable?
The cost of the lottery was Rs 50, while its prize money is highest at Rs 1 crore. However, these gains are part of 'Income From Other Sources' of the IT Act, and hence are liable for taxes and other charges.
There is 30% tax rate on Kerala lotteries along with 10% agent commissions on the prize money. The agent name is announced along with the winners. However, there is also cess added to the tax rate.
According to Income Tax rules, the section 115BB and Section 194B highlights tax provisions on lottery winnings which are part of 'income from other sources' category.
In general terms, all individuals in India are taxed on two categories --- firstly their salaried income per annum --- and secondly on their gains in 'income from other sources' which can be gains in investment schemes like mutual funds, stocks and much more. Accordingly, gains from selling a asset or winning a lottery ticket are also part of income from other sources.
The section 115BB is applicable on income from winnings like lotteries, crossword puzzle, or race including horse race, or card game and other game of any sort or from gambling or betting of any form or nature whatsoever. This tax provision makes it compulsory for individuals to pay up to 30% tax rate on their winnings from these sources. However, there are no tax exemptions offered on the gains.
Meanwhile, under the Section 194B, the person who is responsible for paying lottery winnings, will deduct income tax during the time of payment. Notably, there is tax deducted (TDS) on winnings of over Rs 10,000 lottery money. However, there no TDS if the winning amount is below Rs 10,000.
