NCLAT Gives Ultimatum in Jaypee Infratech Case

NCLAT has given an ultimatum to resolve the issues between YEIDA and Suraksha Group over Jaypee Infratech by the second week of April or it will proceed ahead.

The National Company Law Appellate Tribunal (NCLAT) has issued an ultimatum in the Jaypee Infratech case, stating that if the issues between Yamuna Expressway Industrial Development Authority (YEIDA) and Suraksha group are not settled by the second week of April, it will proceed with the case on its merits.

Background of the Case

In March 2021, the National Company Law Tribunal (NCLT) approved Suraksha group's resolution plan for Jaypee Infratech, which had entered into insolvency resolution process in 2017. However, the process has been delayed due to petitions filed by YEIDA and Jaiprakash Associates, the original promoter of Jaypee Infratech, challenging the approval.

YEIDA's Proposal Under Consideration

During the last hearing on February 19, YEIDA had informed NCLAT that the proposal received from Suraksha group was being considered by the Uttar Pradesh Government. However, in the recent proceedings, YEIDA's counsel stated that the proposal was still under consideration and no final decision had been taken.

NCLAT's Direction

In light of this, NCLAT has made it clear that if no settlement is reached between YEIDA and Suraksha group by the next date, the appeal will be heard on its merits. The appellate tribunal has also directed the Monitoring Committee, set up to oversee the insolvency process, to file a status report within two weeks.

Relief for Homebuyers

The implementation of Suraksha group's resolution plan would provide significant relief to over 20,000 homebuyers who have invested in Jaypee Infratech projects. According to the latest newsletter from the Monitoring Committee, Suraksha group has submitted a proposal for an amicable solution to YEIDA, considering the interests of all stakeholders, including homebuyers and farmer families.
