NOYB Challenges Meta Platforms' Paid Ad-free Subscription Service, Details Here

Meta Platforms' newly launched ad-free subscription service, digital rights advocacy group NOYB (None Of Your Business) filed a complaint with the Austrian Data Protection Authority on Tuesday. The group alleges that Meta's subscription service, which offers an ad-free experience for a monthly fee, infringes upon EU regulations by essentially turning privacy into a paid commodity.

Meta, the parent company of Facebook and Instagram, introduced the paid service last month, allowing users to opt for an ad-free experience for 9.99 euros ($10.90) per month for web users and 12.99 euros for iOS and Android users. According to Meta, the move is a response to EU rules requiring users to have the option to choose whether their data is collected and used for targeted advertising.

However, NOYB challenges Meta's interpretation of consent. "EU law requires that consent is the genuine free will of the user. Contrary to this law, Meta charges a 'privacy fee' of up to 250 euros per year if anyone dares to exercise their fundamental right to data protection," stated NOYB data protection lawyer Felix Mikolasch.

NOYB argues that the subscription fee transforms data privacy, a fundamental right, into a commodity that users must pay for. The group also criticized the amount of the fee, calling it unacceptable. NOYB asserted, "Not only is the cost unacceptable, but industry numbers suggest that only 3% of people want to be tracked - while more than 99% don't exercise their choice when faced with a 'privacy fee.' If Meta gets away with this, competitors will soon follow in its footsteps."

NOYB has a history of filing complaints against major tech companies for privacy violations, including Alphabet Google and Meta. In this latest move, the advocacy group is urging the Austrian privacy authority to expedite the process and halt Meta's subscription service. They also seek the imposition of fines on Meta.

The complaint is expected to be forwarded to the Irish data protection watchdog, responsible for overseeing Meta due to the company's European headquarters being located in Ireland. This development underscores the potential for broader regulatory scrutiny over the intersection of privacy and subscription services within the tech industry.
