The tensions of who will rule West Bengal have become the talk of the town. The saffron party, BJP, made a strong and historic win in West Bengal's 2026 assembly election, which was a slap to TMC's Mamata Banerjee, who has ruled the state for the past 15 years. The new poll results are the end of Mamata's era and reign but a new beginning to the BJP.

In the 2026 election, the BJP won 207 seats compared to Mamata's TMC who only won 80 seats. Mamata also lost her own seat in Bhabanipur to the BJP's Suvendu Adhikari.

Following this, the BJP is reportedly going to form a new government and a swearing-in is expected on Saturday. However, the fiercest woman politician in India refuses to resign.

To reporters, she said, "There is no question of my resignation. I will not resign," adding, "we did not lose the election." She blamed the Election Commission for her defeat and accused them of acting in a partisan manner.

She called the outcomes of the 2026 poll the "brutal murder of democracy," adding, "a chapter in history has been created."

Q1. Can a chief minister refuse to resign after losing an election?

Under the Constitution (Amendment) Bill 2024, the chief minister shall be appointed by the Governor and the other Ministers shall be appointed by the Governor on the advice of the Chief Minister, and the Ministers shall hold office till such time they enjoy the confidence of the Legislative Assembly of the State."

According to the Vajiram and Ravi explainer, a Governor cannot arbitrarily dismiss a Chief Minister who continues to enjoy the confidence of the Legislative Assembly in practice. The real test of legitimacy remains majority support in the House.

When there is a doubt on whether the chief minister still enjoys confidence in the legislative assembly, a floor test becomes mandatory.

During the floor test, the chief minister will have to prove and verify that it has a majority of support in the Parliament House. The CM will have to prove they have the support of more than half of the sitting MLAs.

If the CM fails to prove a majority in the House, resignation is required to let the winning party form a government.

However, the BJP would likely not face these protocols because Mamata and her TMC's tenure ends on May 7, 2026.

Article 172 of the Constitution highlights that a state legislative assembly serves a five-year tenure, starting from the date of the first meeting after the party forms the state government. After five years, the current assembly automatically dissolves if a new party is elected.

The current West Bengal legislative assembly started its tenure on May 8, 2021. Hence, TMC's tenure is ending on May 7, 2026.

Once the tenure ends, the governor of the state can commence the process of appointing the new government, where new MLAs will take their oath along with a new chief minister. However, these new MLAs and CM should have majority support in the House as well.

If both parties fail to prove majority support in the House, the state will come under Article 356, which opens the gate for presidential rule.

Under Article 356 of the Constitution of India, if a state government is unable to function according to Constitutional provisions, the Union government can take direct control of the state machinery.
