Samsung India Challenges USD 500 Million Penalty Imposed by Customs Authorities at CESTAT

Samsung India is contesting a significant penalty imposed by Indian customs authorities. The company has approached the Customs Excise & Service Tax Appellate Tribunal (CESTAT) to challenge a fine exceeding USD 500 million. Samsung's network division reportedly classified the equipment under a tariff rate of 10-20 per cent. The appeal has been filed with the Mumbai bench of CESTAT through the law firm Lakshmikumaran & Sridharan. However, the hearing date for this petition is yet to be scheduled. Sources indicate that it will be addressed by a CESTAT bench in due course.

Samsung's network equipment was supplied to Reliance Jio, a major telecom provider under Mukesh Ambani's Reliance Industries. This connection highlights the broader industry implications of the customs dispute, given Reliance Jio's prominent role in India's telecom sector.

Financial Context and Company Response

In the fiscal year 2023-24, Samsung India Electronics reported revenues close to Rs 1 lakh crore. Of this, Rs 16,626 crore was attributed to its network business. Despite repeated attempts for comments, Samsung has not yet responded to queries regarding this issue.

The outcome of this legal challenge could have significant financial implications for Samsung India. The resolution will also be closely watched by industry stakeholders given its potential impact on telecom equipment imports and tariffs.
