SC Rejects GoFirst's Plea Challenging Delhi HC Order Granting Lessors Access to Planes

The Supreme Court of India On Monday rejected Go First's Resolution Professional's appeal against the Delhi High Court's decision allowing the airline's lessors to inspect the aircraft. The supreme court ruled that it is currently unable to intervene because the cases are being heard by a single judge on a daily basis.

The National Company Law Tribunal asked the RP on Friday to submit details of current developments and to file an additional affidavit in the next 10 days, including the status of the leased aircraft maintenance.

Go First suspended operations on May 3, 2023, and voluntarily requested the beginning of CIRP against the company, owing to technical challenges caused by the non-availability of Pratt & Whitney engines.

Go First's request to begin voluntary insolvency resolution procedures was accepted by the NCLT on May 10. Go First's RP requested NCLT approval last week to repay Rs 597.54 crore to about 15.5 lakh travellers who purchased tickets for travel on and after May 3.

The lenders and insolvency regulator IBBI had received notification of this from the NCLT.
