The National Company Law Tribunal (NCLT) has dismissed the insolvency petition filed against the airline by Wilmington Trust SP Services marking a victory for SpiceJet, The announcement came from SpiceJet itself on January 30, providing a sigh of relief for the airline and its stakeholders.
"The insolvency plea stands dismissed," declared a bench of NCLT, featuring members Mahendra Khandelwal and Rahul Prasad Bhatnagar, on January 29. This verdict concludes a legal battle initiated by Wilmington in June 2023, citing unpaid dues from the airline.

The legal tussle gained momentum when the Directorate General of Civil Aviation (DGCA) took action in May 2023, deregistering three planes belonging to SpiceJet at the request of lessors, including one aircraft owned by Wilmington Trust SP Services. Subsequently, Wilmington Trust SP Services, along with Sabarmati Aviation Leasing and Falgu Aviation Leasing, approached the civil aviation regulator, urging the deregistration of three Boeing 737-800s due to non-payment of dues.
SpiceJet, in its defence, contended that Wilmington was associated with Aircastle, a lessor that had already lodged two insolvency pleas against the airline. The legal saga further unfolded when the NCLT, on May 8, 2023, agreed to hear Aircastle's plea seeking unpaid dues from SpiceJet. However, the airline expressed confidence in resolving the matter outside the courtroom and clarified that it did not admit any liabilities to Aircastle.
In a statement released in May, SpiceJet assured stakeholders, "Presently there are no aircraft from this lessor in our fleet. All aircraft from this lessor have already been returned by SpiceJet. This development, in no manner, affects our operations or operating fleet. We are confident of resolving the matter without court proceedings and we are in discussions with their senior leadership team for the same. The comments provided here are without prejudice to our rights and in no way should be deemed as an admission of any liabilities."
The dismissal of the insolvency petition by NCLT marks a turning point for SpiceJet. The airline can now redirect its focus and resources toward operational efficiency without the looming threat of insolvency proceedings. The successful defence against Wilmington's claim is likely to boost confidence among investors and industry observers.
As of 11:30 am on the Bombay Stock Exchange (BSE), the shares of SpiceJet were trading with gains of nearly 2%, reaching Rs 65.45 per share.
While SpiceJet remains under financial scrutiny, the dismissal of the insolvency plea signifies a notable victory for the airline. The industry will now keenly observe how SpiceJet strategically navigates this outcome to reinforce its financial standing and rebuild trust among its stakeholders.
