Supreme Court Orders Interim Stay on ED Probe of Noida's Lotus 300 Project

The Supreme Court of India has recently put a temporary halt on the Allahabad High Court's directive for an Enforcement Directorate (ED) investigation into the financial dealings associated with the Lotus 300 luxury housing project in Noida. This decision was made by a vacation bench comprising justices Sanjay Kumar and Augustine George Masih. The high court's order, issued on February 29, called for a thorough ED probe into the alleged financial discrepancies linked to the unfinished Lotus 300 project situated in Noida's affluent Sector 107.

The project, which was to be developed by Hacienda Project Private Limited (HPPL) in partnership with Pebbles Infrotech as the leading member and 3C as its parent company, has been under scrutiny. The Allahabad High Court criticized the Noida Authority for its significant negligence over more than a decade, which resulted in a substantial increase in its dues without taking steps to verify the status of payments.

In response to these developments, the Supreme Court's interim order has paused the high court's directive until further notice. However, it emphasized that all involved parties should work towards fulfilling the high court's instructions outlined in paragraph 117 of its order. This particular paragraph mandates the Noida Authority to issue occupancy or part-completion certificates and to formalize tripartite agreements and registered deeds for flat buyers within a specified timeframe.

The controversy stems from paragraph 114 of the high court's order, which demands an ED investigation against all directors, promoters, and entities linked to HPPL where funds might have been improperly allocated or stored. The high court had instructed these individuals and entities to cooperate with the ED's investigation, warning that non-cooperation could lead to legal actions as per the law. Additionally, it tasked the ED with making earnest efforts to recover owed amounts and settle all creditors' dues.

This interim stay by the Supreme Court brings temporary relief to the stakeholders of the Lotus 300 project but also underscores the judiciary's intent to ensure accountability and transparency in real estate transactions. The directive for cooperation with ongoing investigations and compliance with legal obligations remains a critical aspect of this legal saga.
