In a significant development, the Supreme Court has put a temporary halt on the Allahabad High Court's directive for an Enforcement Directorate (ED) investigation into the financial dealings associated with the Lotus 300 luxury housing project in Noida. This interim stay was issued by a vacation bench comprising justices Sanjay Kumar and Augustine George Masih on Tuesday. This move comes after the Allahabad High Court, on February 29, had mandated an ED probe to look into the alleged financial discrepancies tied to the unfinished Lotus 300 project situated in Noida's affluent Sector 107.

The controversy centers around the Lotus 300 project, which was developed by Hacienda Project Private Limited (HPPL), a consortium led by Pebbles Infrotech, with 3C Company serving as its parent entity. The Allahabad High Court had previously criticized the Noida Authority for its "gross negligence" in monitoring the financial transactions and failing to collect dues from the project, which have now escalated to approximately Rs 166 crore.
While issuing the interim stay, the Supreme Court bench highlighted that all involved parties should work towards implementing the directives outlined in paragraph 117 of the High Court's order within the stipulated timeframe. This particular paragraph mandates the Noida Authority to grant occupancy or part-completion certificates and to finalize tripartite agreements and registered deeds in favor of the flat buyers within a month.
The High Court's order had specifically targeted all directors, promoters, designated promoters, officers in default, companies, and other entities linked to HPPL for an ED investigation. It was instructed that these parties should cooperate with the probe, failing which the ED would be authorized to take any suitable action as per the law. Additionally, the ED was tasked with making earnest efforts to recover the owed amount and settle all dues of creditors.
This judicial intervention by the Supreme Court temporarily suspends the ED investigation into Lotus 300's financial transactions but underscores the necessity for compliance with other aspects of the High Court's ruling aimed at protecting the interests of flat buyers and creditors alike.
