Tesla CEO Elon Musk has launched a legal battle against artificial intelligence (AI) powerhouse OpenAI, accusing the company of veering off its altruistic mission and becoming a profit-driven subsidiary of tech giant Microsoft. Musk, a former board member of OpenAI, filed the lawsuit on Thursday, levelling charges of breach of contract, breach of fiduciary duty, and unfair business practices.

According to Musk, OpenAI, which originally aimed to develop AI systems for the betterment of humanity, has transformed into a closed-source entity prioritizing profit for Microsoft. The lawsuit, filed in San Francisco Superior Court, contends that OpenAI must revert to its open-source roots and adhere to its foundational agreement.

"OpenAI, Inc. has been transformed into a closed-source de facto subsidiary of the largest technology company in the world: Microsoft. It is refining an AGI to maximize profits for Microsoft, rather than for the benefit of humanity," Musk asserted.

The legal action names OpenAI President Gregory Brockman and CEO Sam Altman as co-defendants. Musk has also sought an injunction to prevent Microsoft and top OpenAI officials from profiting from AI technology usage.

One of Musk's key claims is that Microsoft played a pivotal role in retaining Sam Altman as OpenAI's CEO after his removal last year. Allegedly, board members who sought Altman's removal were compelled to resign, with Microsoft stepping in to preserve Altman's position. Musk contends that the current board lacks expertise in artificial intelligence and technology, asserting that the once carefully crafted non-profit structure of OpenAI has given way to profit-driven decision-making.

"OpenAI, Inc.'s once carefully crafted non-profit structure was replaced by a purely profit-driven CEO and a Board with inferior technical expertise in AGI and AI public policy. The board now has an observer seat reserved solely for Microsoft," the lawsuit claims.

Elon Musk's association with OpenAI dates back to 2018 when he resigned from the board due to disagreements with then-CEO Sam Altman regarding the development of GPT-4 and concerns about the potential risks posed by advanced AI, particularly in terms of public safety.

Musk's lawsuit brings to light the delicate balance between the ethical development of AI technology and the corporate interests that may shape its trajectory. The legal battle could have far-reaching implications for the future of OpenAI and Microsoft's involvement in the AI landscape.
