UP Police Chief Cautions Against Unfounded Legal Actions on Businesses

Uttar Pradesh police chief Prashant Kumar has instructed that a preliminary investigation should be conducted before filing cases against entrepreneurs and businesses. He emphasised that unfounded FIRs discourage investment in the state. In his directives to senior police officials, Kumar stressed the need for caution when registering FIRs against business entities such as builders, factory operators, hotels, hospitals, and educational institutions.

Kumar highlighted that misusing the judicial process to file baseless FIRs against entrepreneurs contradicts the government's policy of attracting investment and promoting MSMEs. He noted that such actions could deter businessmen from investing in Uttar Pradesh. "Entrepreneurs are the backbone of our economy, and it is our duty to ensure that they operate in a conducive environment free from unwarranted legal challenges," he said.

Supreme Court Guidelines

The DGP referred to the Supreme Court's instructions on various cases, including matrimonial disputes, business crimes, medical negligence, and corruption. The court has advised conducting investigations before registering FIRs in these instances. Kumar reiterated that if a cognizable offence is not evident from the application or if there is doubt, an investigation should determine whether an offence has been committed before filing an FIR.

Business Disputes

Business organisations have frequently reported that FIRs are being registered by giving a criminal colour to business disputes, which are essentially civil matters. Kumar mentioned that in case of accidents in establishments, management-level individuals with no direct connection to the incident are often named in FIRs. This practice needs to be addressed to prevent unnecessary legal challenges for businesses.

Ensuring Fair Investigations

The directives also stated that during investigations, both parties involved should be given an opportunity to present their side. The inquiry officer must include records provided by both parties in the investigation report. This approach aims to ensure fairness and transparency in handling complaints against businesses.

Kumar's directives aim to balance addressing genuine grievances and discouraging baseless complaints that hinder business operations. By requiring a preliminary enquiry, the police hope to create a more favourable environment for entrepreneurs and businesses in Uttar Pradesh.
