UP RERA Sets Standard Possession Letter Format for Flat Buyers

In a significant move to streamline the process of handing over possession of flats and to mitigate disputes between promoters and buyers, the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has introduced a standardized format for the offer of possession letters. This initiative, announced on Saturday, aims to eliminate the confusion and binding conditions often imposed on allottees through such letters.

Standard Possession Letter Format Set

The UP RERA's decision comes in the wake of its order dated May 29, which mandated that promoters must issue possession offers in a uniform format provided on the authority's website. This directive also prohibits promoters from imposing any binding conditions on the allottees through these letters. According to UP RERA Chairman Sanjay Bhoosreddy, the move is designed to clarify the purpose of possession offers, which should solely facilitate the process of taking possession.

The authority highlighted that previously, promoters would send final demand letters and notices under the guise of an offer of possession, leading to confusion among buyers. These communications often contained binding conditions, contrary to the intended purpose of simply facilitating possession.

To combat this issue, UP RERA has now made a model offer of possession available on its portal. Any deviation from this format will be considered invalid, ensuring clarity and aiding in the resolution of related disputes. Bhoosreddy emphasized that this measure would help eliminate confusion among stakeholders and expedite dispute resolution.

Furthermore, UP RERA outlined the procedure for issuing these letters. Upon receiving the occupancy certificate (OC) or completion certificate (CC) for a project, promoters are required to send offer of possession letters to allottees via registered email and residential address. Additionally, allottees will be informed via SMS and phone calls. Promoters must also display relevant information at both the project site and their head office.

The regulatory authority stressed the importance of uniformity in the language and intent behind these letters. The core objective should be to invite the allottee to take possession of their unit. If any construction work remains incomplete, promoters must clearly outline the pending tasks and the expected completion timeline. Moreover, any liabilities on part of the allottee should align with the Agreement for Sale and be legally justified.

UP RERA also specified that offer of possession letters should be dispatched within two months of receiving the OC/CC. At the time of possession, allottees must be provided with a copy of the OC/CC certificate issued by the development authority. This step ensures that all parties have a clear understanding of their rights and obligations during the possession process, thereby reducing potential conflicts.

This initiative by UP RERA is expected to bring about greater transparency and efficiency in the real estate sector, particularly in the crucial phase of handing over possession. By standardizing communication between promoters and buyers, UP RERA aims to foster a more harmonious relationship between these parties, ultimately benefiting the real estate ecosystem in Uttar Pradesh.
