No Justification for Super Area
According to UP RERA, there is no legal basis or justification for the use of Super Area in real estate transactions. The authority emphasizes that the sale of apartments based on Super Area is illegal, and only transactions based on carpet area are considered legal under the provisions of the Real Estate (Regulation and Development) Act (RERA) Act.
Carpet Area as the Actual Area
UP RERA Chairman Sanjay Bhoosreddy stressed the importance of considering the carpet area as the actual area of a unit or apartment. He urged allottees to pay promoters based on the carpet area to ensure fair and transparent transactions.
RERA Act and Model Agreement for Sale
The RERA Act 2016 requires promoters to specify the number of units, their types, floor, balcony, terrace, and area of other spaces while registering a project on the portal. The actual area of floor space among internal walls, known as the carpet area, must be clearly stated.
Additionally, a model agreement for sale provided on the UP RERA portal is based on the carpet area. This further reinforces the illegality of selling apartments or units based on Super Area.
Legal Action for Violations
UP RERA warns promoters that violating the directive to sell units based on carpet area only may result in legal action. The authority is committed to ensuring compliance with the RERA Act and protecting the rights of allottees in real estate transactions.
The Uttar Pradesh RERA's directive to housing project developers to sell units based solely on carpet area is a significant step towards transparency and fairness in the real estate sector.
