Judge Recusal Request in Georgia Election Records Case Cites Impartiality Concerns
The US Department of Justice is asking a judge to recuse herself from a Georgia election records dispute, citing impartiality concerns after reports she attended an event honouring Fulton County District Attorney Fani Willis. A court investigation also led to a private reprimand of an unnamed 11th Judicial Circuit judge. The judge has not commented.
The US Department of Justice asked a federal judge to step aside from a case over Georgia election records. The department said the judge’s past attendance at an event linked to Fulton County District Attorney Fani Willis raised concerns. Willis prosecuted President Donald Trump in a separate Georgia election case. The department said these circumstances could affect public trust in neutrality.

The request concerns a lawsuit the Justice Department filed against Georgia Secretary of State Brad Raffensperger. The agency sought access to statewide voter lists as part of similar suits elsewhere. Raffensperger said Georgia law blocks release of confidential voter details without set conditions. Raffensperger said those conditions were not met. Raffensperger said the public part of the roll was sent in December.
Georgia election records case and hearing schedule
US District Judge Eleanor Ross in Atlanta is overseeing the dispute. Ross set a hearing for Wednesday in the election records matter. However, the Justice Department asked to delay the hearing. The department linked the delay request to the motion seeking recusal. The Associated Press said it did not independently confirm the judge’s identity.
A person who answered the phone in Ross chambers on Friday said the judge was unavailable. The caller referred questions to the court’s media office. The office said, "Judge Ross has no comment right now.\" A second email sent on Saturday did not get an immediate response. The email asked about the recusal motion and related reporting.
Justice Department arguments on Georgia election records
\"A judge who attended a party celebrating the election of a Democrat best known for prosecuting a Republican President for alleged election interference cannot then preside over a case concerning that Presidents efforts to ensure election integrity, Justice Department lawyers wrote in their filing Friday.\"
The Justice Department also argued that a reasonable observer could view attendance at Willis’ election night party as support. The filing said such an appearance could suggest bias in an election-related dispute. \"If Judge Ross is indeed the Subject Judge, that conduct gives rise to an appearance of bias, which requires Judge Ross to recuse herself from this election-related case, the Justice Department filing says.\"
Judicial discipline case tied to Georgia election records motion
The recusal request followed a separate disciplinary matter involving an unnamed federal judge in the 11th Circuit. A February order by the Judicial Council of the 11th Circuit issued a private reprimand. The order kept the judge’s identity and location confidential. The 11th Circuit covers Alabama, Florida and Georgia. On May 22, a Judicial Conference committee affirmed that order.
The investigation report said the judge had sex in a courthouse with a high-ranking uniformed police officer. Staff were within earshot, according to the report. The report also said the judge attended a partisan event. It said the judge initially made false statements to deny the allegations. The Justice Department noted these claims briefly, but said they were not central.
Media reports identified Ross as the judge involved in the discipline case, and the Justice Department relied on those accounts. The report said the judge went to an event hosted by a district attorney’s campaign. The judge said the visit was to meet former colleagues at a private mixer. The mixer was in the same venue, but separate from a victory party.
Fani Willis, Trump, and 2020 Georgia election case background
Willis began investigating Trump and others after taking office in January 2021. The inquiry focused on possible interference in the 2020 election in Fulton County. It included a January 2021 call where Trump urged Raffensperger to find votes. Trump sought to overturn Democrat Joe Biden’s win in Georgia. The prosecution later became a major public case.
In August 2023, Willis obtained an indictment against Trump and 18 others. Prosecutors alleged a broad effort to reverse Georgia’s 2020 election results. The case was dismissed in November. An appeals court cited an appearance of impropriety. The issue involved a romantic relationship between Willis and an outside lawyer leading the prosecution.
Federal judges serve for life, but discipline can include reprimands and limits on case assignments. Removal can happen only through impeachment by Congress. Ross was nominated in January 2014 by then-President Barack Obama. The Senate confirmed Ross in November that year. Ross served as a state court judge in DeKalb County from 2011.
Before becoming a federal judge, Ross worked for over a decade as a prosecutor. The work included state and federal roles, mostly in Atlanta. Ross also previously worked in the Fulton County district attorney’s office. Ross overlapped with Willis there, before Willis became district attorney. Those links were cited in arguments about appearances and impartiality.
Separately, the Atlanta Police Department said it opened an investigation into the law enforcement officer. Officials said the inquiry will check if the high-ranking officer is from the department. The Justice Department’s motion focused on recusal and scheduling in the records case. The court has not publicly ruled on the request, and the hearing remains in question.
